Highlights
We secured for our clients (Plaintiffs Daryabari and Bineshpajooh) a major victory in the California Court of Appeal last week (Daryabari et al v. Rajabi et al, Los Angeles County Super. Ct. No. 22VECV02533 and Court of Appeal Case No. B330485). The appellate court affirmed the trial court’s ruling, striking defendants’ anti-SLAPP motion on key causes of action. The Court found that our claims for defamation, false light, and civil harassment had merit, and that we made a prima facie showing of actual malice, a very difficult burden to meet:
"The trial court found plaintiffs made a prima facie showing of actual malice through evidence that: (1) defendants failed to investigate the truthfulness of their claims, (2) Ebrahimzadeh displayed signs of regret and remorse regarding his allegations against plaintiffs, (3) he relied on other social media posts without making any effort to determine whether these posts were reliable, and (4) he made these accusations ‘at a time when those allegations would cause a significant outcry.’”
I’d like to thank our team of talented, experienced, and brilliant litigators who made this victory possible. Special thanks to Alpha Trial Group, LLP's Richard Welsh and Jeffrey Zuidema who have been a force to recon with since the day we commenced this litigation. Your mastery of procedural rules, deep knowledge of the law, and strategic wisdom made this victory possible. And a warm "thank you" from this lawyer to you for your selfless dedication to preparing me for oral arguments before the Court of Appeal and the trial court. Yes, Rangers Lead The Way, indeed! Go Alpha Company, 1/75!
I also would like to thank an amazing litigator and creative thinker Shireen Tavakoli of One Law Litigation whose invaluable input and unparalleled research and writing skills made our appellate brief a work of art. Your incredible talent in breaking down and presenting complex legal issues has left me in awe.
