Wow ANOTHER ridiculous sales tax software story this week. Sometimes I lose faith in humanity knowing what some of these sales tax apps are doing in the world.

We’ve got another company hoodwinked by one of the sales tax apps (one of the big ones, btw). Shaking the client down for BIG BUCKS for professional service fees.

But they skipped the MOST critical step for this client. A step that is borderline gross negligence to skip: having a product taxability conversation.

Picture this … A sales tax software company sells you on a nexus review service to determine where you owe sales tax. Then they charge you for a Voluntary Disclosure Agreement to pay past-due tax. Oh and then there’s the permit registration, software setup fees, not to mention paying that sales tax out of pocket.

It is lots of money. More money than anyone would like to pay.

THEN YOU FIND OUT (after going through the wringer and eventually reaching out to TaxValet for help) that what you sell isn’t. Even. Taxable.

There’s really no way it is. Even in states that tax just about everything like New Mexico or Hawaii. There’s still no way it’s taxable there.

The sales tax software app never insisted (like we would have) that conducting a product taxability analysis should have been done FIRST.

Why? Well.. again, I can’t say if it’s incompetence of malevolence. But what I will say is this: by conveniently leaving this step out, the software company made out like a BANDIT.

All at the expense of the business.

You hate to see it …

We need to put an END to sales tax software companies (old AND new) putting profit over people and common sense business practices.

We see some pretty despicable stuff in the sales tax world by other providers. It’s hard to know if it’s due to malevolence or just simply a lack of competence. I want to believe it’s just incompetence. But even that still isn’t great.

We are onboarding a new client coming to us from one of those new sales tax softwares. One that claims to “do it all”.

Get this: They conducted a nexus review and advised the client to open a ton of permits across the country. They did the nexus review based on total sales, not properly considering product taxability in the economic nexus calculation. In fact, there is NO evidence that product taxability was a talking point at all during their initial onboarding process with this startup 🚩🚩🚩.

The result? A ton of permits opened in states they didn’t need them. That makes for BIG MONEY for the weird software startup. Oh and messed up tax settings (no big deal … WAIT — HUGE DEAL!).

And without revealing too much about the client, I’ll just say this - it would be obvious to anyone with any degree of understanding of sales tax that these products would not be considered taxable in many states.

This level of incompetence is kind of like “doctors not knowing to wash their hands” or “gardeners not knowing to water their flowers”. That’s the kind of gross incompetence we’re talking about here. It’s just not okay.

I don’t like it when businesses cut corners. I just wish they were more honest and upfront about it, if that’s what they’re doing. Don’t hoodwink businesses into thinking you have sales tax experts on your team when nothing could be further from the truth. It’s insulting to the profession. It makes us all look bad.

If you’re gonna do something, do it the right way. That’s what we believe at TaxValet, at least. ✌️
