Tomorrow, I'm scheduled to undergo arthroscopic surgery to repair a torn meniscus in my knee. Today, I was informed by the outpatient surgery center that I'll need to wear a knee brace for a few days following the procedure. They also informed me that the brace needs to be put on my leg in the operating room at the end of my operation.

When I asked, I was told that the cost of the brace will be $3,300 per the "in-network" contracted rate between the surgery center and the PPO insurance network that our company health plan uses. I'm required to pay 10% of that, which amounts to $330. My company, Collective Health, will be paying the remaining ~$3,000 to cover the total cost of the brace.

Upon researching the make and model of the brace, I was able to find that the same brace is available on Amazon and other medical equipment websites for $150-200 (https://a.co/d/hHBkQ1F). When I reached out to the surgery center with this information, I was told that the contracted rate still stands and that I'm not allowed to buy the brace on my own and bring it to the surgery.

Effectively, my company and I are paying a $3,000+ mark-up on a $200 brace because it is being force-sold to me as part of the network contract between the surgery center and the PPO network that our employee health plan is contracted with.

There are approximately 750,000 knee arthroscopies performed each year in the US. That would imply that we are collectively paying a $2 billion ($3,000•750,000) tax for these types of knee braces each year alone. Again, all for a basic $200 knee brace that you or I can buy on Amazon.

This simple example highlights the negative economic effects that arise when powerful intermediaries control markets and when large incumbents in a market are allowed to amass and abuse their market power behind a willfully constructed veil of complexity and obfuscation. All while federal and state regulators sit by idly, paralyzed by massive lobbying and other political efforts that make their investigating abusive market practices like this political or career suicide.

And it’s why we at Collective Health believe so strongly in empowering those who ultimately foot the bill for our healthcare—employers and their workers (i.e., the real “payers”)—to fully understand what they’re paying for and why, and to fully exercise their buying power to make these and other types of abusive price-gouging practices a thing of the past.
