Highlights
We are pleased to have worked with Ryan Transactional Risk to resolve a W&I claim resulting in a payment in excess of EUR 11.5 million. The claim involved allegations of fraudulent manipulation of financial statements which led to the insolvency of the target company. The resolution of this complex claim demonstrates the benefit of placing policies with both insurers and brokers offering specialist claims teams dedicated to W&I claims. Howden M&A’s claims team collaborated with Alex White of Ryan Transactional Risk as well as the target’s creditors and their lawyers to negotiate an attractive settlement. This positive outcome demonstrates the value W&I policies bring to insured parties in mergers & acquisitions.
We are pleased to share that B&C KB Holding GmBH has received a c. EUR 120 million claims payment from W&I insurers, Riskpoint Group and Liberty Global Transaction Solutions, for losses relating to its acquisition of the Schur Flexibles Group, in 2021 (https://lnkd.in/e5Kv-wks). Howden M&A placed the insurance tower for this transaction, which has produced the largest payment for an EMEA W&I policy to date and is a landmark moment for W&I insurance. The successful resolution of the first stage of this claim demonstrates the value a bespoke W&I insurance policy can provide to buyers, with a claim against a third insurer in the tower continuing. We congratulate B&C on the successful settlement of this part of the claim and thank all parties involved for supporting B&C.
