Yesterday, I posted about an attorney who was caught fabricating expert disclosures and preliminary reports; and now a #medical expert witness from Harvard University has been disqualified for #plagiarising his expert report.

The expert, a pathologist from Harvard, was retained by the Plaintiffs on the issue of general causation, and submitted an over 500 page report, about Lockheed Martin's weapons manufacturing facility in Orlando giving off toxic chemicals that contaminated the surrounding air, soil, and groundwater.

The district judge noted that the expert's "report is - put plainly - a mess" and it simply could not put it in front of a jury.

The Daubert factors do not identify #plagiarism as a ground for exclusion. However, when the plagiarism is so blatant that it represents deliberate lack of candor, it may cause the report to be unreliable enough to justify exclusion.

What went against the expert in this case is that on top of the "direct lifting", he repeatedly "outright refused to acknowledge the long swaths of his report that quoted other work verbatim without any quotation marks at all—instead stubbornly insisting that he cited over 1,100 references, as if that resolved the attribution issue."

The order of the Court is attached and would make an interesting read ⬇
