A few follow up points on the $10,200 unemployment exemption- Although the IRS is issuing refunds of tax paid on unemployment to folks who filed their returns before the exemption was enacted into law, without having to amend your return. that may not be the end of the story. The IRS is not factoring into the calculation of the refund tax credits you may become eligible for as a result of the the exclusionn reducing your AGI. The two income dependent credits that most readily come to mind are the Earned Income Credit and the Child Credit. To claim these, you will likely need to amend your return. Also- while many states follow the federal law and exclude unemployment from tax, not all do, or at least not all have so stated -one way or another (“I’m gonna getcha getcha getcha getcha..” - sorry for that musical digression).. New York it now appears will NOT allow the exemption - the add back should be on Form IT-558 code A-011...). Oh fuss! Oh bother!

And.. I don’t know that any state that does allow the exemption is calculating the refund for you.. so you may need to amend your state return to get any refund to which you may be entitled..

In IR-2021-59, Treasury and the IRS announced yesterday that the federal income tax filing due date for individuals for the 2020 tax year will be automatically extended from April 15, 2021, to May 17, 2021. The IRS is expected to issue formal guidance in the coming days. You don’t need to file anything or call the IRS for the extension- like the title to song by Air Supply says, it’s automatic.. NOTE! the extension DOES NOT apply to trusts, C Corps., or other taxpayers that are not individuals whose return is first due April 15, 2021. And most notably, and inexplicably, the IRS announced it does NOT apply to 2021 estimated payments due April 15, 2021, including individual estimates. So... many if not most taxpayers who pay estimates pay so-called “protective” estimates- equal to 100 or 110%, depending on income level, of their prior year tax. So the 2020 individual return is now due May 17th, but,the first 2021 protective estimate, which is supposed to be based on the tax from the 2020 return, is STILL due April 15th? That seems... odd? Let’s hope the IRS rethinks this particular issue before they issue formal guidance.. but I wouldn’t count on it..
