My brother's brilliant idea: SOLUTION FOR LONG-TERM UNDOCUMENTED IMMIGRANTS Robert Kim Bingham, Sr. Retired ICE attorney   SENSIBLE SOLUTION: Congress should fix clause “(a)” of section 249(a) of the Immigration and Nationality Act (“Act”), by replacing the obsolete date “January 1, 1972” therein with “June 15, 2007.” This tiny fix to the law could benefit millions of long-time undocumented residents and “Dreamers,” by enabling them to apply for lawful permanent residence under section 249(a) of the Act.   OBSOLETE DATE NEEDS TO BE REVIVED. This substantial LPR benefit is currently available only to those who entered the United States before “January 1, 1972” — over 49 years ago!   TIME FOR CONGRESS TO ACT. In light of the hardship of longtime undocumented residents fearful of removal, it’s time for Congress to update section 249(a) of the Act to make this relief once again available in today’s immigration proceedings. Simply replacing the obsolete date “January 1, 1972” with “June 15, 2007” would enable countless individuals to apply for lawful permanent residence status.   EXISTING REQUIREMENTS MUST STILL BE MET. Undocumented immigrant applicants would still need to satisfy the few elements in section 249(a) of the Act, For example, they would need to show that they have resided “continuously”` in the United States since their entry before January 1, 1972, show they possess good moral character, and establish they’re not in a class of “inadmissible criminals, procurers, and other immoral persons, subversives, violators of the narcotic laws or smugglers of aliens.” Section 249 of the Act. BURDEN OF PROOF. Every applicant would bear the burden of proof for section 249 relief, whether or not the application is filed with an immigration court (EOIR) or a DHS/Citizenship and Immigration Services (CIS) office, This solution could attract bipartisan support because of its simplicity, humanitarian impact, and avoidance of comprehensive immigration issues.   BENEFITS RECEIVED BY APPLICANT. If Congress updates the provision of the Act as recommended herein all successful applicants thereunder would receive the benefit of a green card, employment authorization, the right to reside permanently in the United States without fear of removal, the right to travel in and out of the country at will, and the right to apply for U.S. naturalization after five years (or three years if married to a U.S. citizen) after receiving the coveted lawful permanent residence status.   Robert Kim Bingham, Sr. Retired ICE attorney                                                       Salem, CT [email protected]   #immigration
