As expected, properly drafted non-competes will remain enforceable in Texas. The Fifth Circuit and Supreme Court will likely uphold this ruling. #Texas #business #litigation #noncompetes

Brief update on the FTC's attempt to ban #noncompetes, which is scheduled to go into effect on Sept. 4. Last week, a federal court in Pennsylvania ruled that the FTC does have the authority to issue such a rule, and denied the request for an injunction. This directly conflicts with the ruling entered a few weeks ago by Judge Ada Brown here in the Northern District of Texas, holding that the FTC lacks the rulemaking ability to ban noncompetes. There is also a case pending in federal court in Florida. Judge Brown is scheduled to make a final ruling on the merits by Aug. 30. Hospital, insurance, and financial services organizations have filed amicus briefs opposing the regulations.

The recent ruling by the U.S. Supreme Court overturning the Chevron doctrine, under which courts give deference to federal agencies, casts further doubt on whether the ban will survive legal challenges. We continue to closely monitor.
