USCIS has announced that the initial registration period for the FY2023 H-1B cap will open at 12 pm (ET) on March 1, 2022 and close at 12 pm (ET) on March 18, 2022. During this period, prospective employers will be able to complete and submit their registrations in respect of proposed H-1B “Specialty Occupation” workers.
The H-1B visa is the most popular visa category for employers seeking to hire individuals in professions that require at least a Bachelor’s Degree in a specific specialty, and allows 85,000 visas to be issued each fiscal year. Upon registration of proposed H-1Bs, USCIS will then conduct a lottery to select companies that may submit H-1B petitions in respect of individuals with at least a Bachelor’s Degree, and a second lottery in respect of those who hold a U.S. Master’s Degree. Employers will then have a 90-day window to file their H-1B petition.
While the registration system means that employers need only provide basic information to enter the lottery, ensuring that there are no issues with a company’s registration requires care. Employers and HR managers should be aware that the process should be started as soon as possible.

Some good news - the White House announced today that, beginning in early November, country-specific travel bans will be removed in favor of vaccine and testing requirements. This means that individuals travelling from China, Iran, the Schengen Zone, Ireland, the U.K., Brazil, South Africa and India who are vaccinated will be able to travel directly to the U.S. as long as they provide proof of vaccination and a negative COVID-19 test within three days of boarding a flight to the U.S. The official announcement, including date of implementation, is still pending.
