Highlights
Revised text of the Tax Relief for American Families and Worker's Act of 2024 (TRAFWA) was released by the U.S. House of Representatives. While the bill can undergo changes before the final passage, there are a couple noteworthy provisions:
- Required 5 year amortization of domestic research expenses under IRC 174 is delayed until 2026. Taxpayers would be able to treat these similar to how they treated them retroactive to 2022 and could use a modified cut-off change in accounting method in 2023, which would avoid having to amend 2022 tax returns.
The delay does not apply to foreign research expenses, meaning those would continue to be capitalized/amortized over 15 years.
- The bonus depreciation rate would be retroactively extended to beginning of 2023 through 2025 at 100%. This would drop to 20% for 2026 before expiring 12/31/2026.

The IRS will stop processing all new Employee Retention Credit refund claims and will continue this moratorium at least through December 31, 2023.
