While I am sure there is more to this situation then is presented in the attached article ...
At this level of. reporting, it presents an intimidating possible precedent. It appears that the researcher was not part of the 'hack' and is just accessing publicly available dark web data. 'His' work disproves a press release which not only minimized the breach, but was factually inaccurate information. That research/data which would be required to debunk the erroneous press release, would also need to be provided to any reputable news organization who would be calling out a government press release as false.
The criminal elements and anyone who can do a basic dark web search already have access to all that data, so it appears (again from what info is available in the article) that the researcher is only making a larger amount of the general public aware of the gravity of the situation which would require specifics.
I can understand the desire to hold someone responsible for the breach of this type of information ... However, with this information in the article, this seems to be not only misdirected, but also a significant overreach. I am disappointed they got a judge to agree, the precedent is likely to have impacts far beyond this situation ...
Extrapolating based on this ruling ... as a security researcher, does it now appear that even your basic due diligence could be prosecutable with this type of precedent ...
