Today we moved one step closer to a civil trial for our client, exoneree Ralph Birch, after the Second Circuit dismissed a last-ditch qualified immunity appeal by two of the officers responsible for his wrongful conviction. It was a privilege to argue this appeal, as it has been a privilege for Doug Lieb and me to represent Ricky since our law firm was barely four months old. Now that the Court of Appeals has rejected these officers' final attempt to avoid accountability for their misconduct, we're looking forward to seeing this case through to its conclusion before a jury.
