I learnt a huge amount from my conversation with Raoul Parekh on the risks of employee misclassification - our most popular podcast so far. Here are a few of my takeaways:

  1. Different countries have different laws - don't presume that if someone is a contractor in one country then someone in a similar role in another country should be employed the same way.

  2. There are lots of grey areas - Raoul mentioned a number of times how the law can be interpreted different ways (check the clip).

  3. These issues can be solved - speak to people who have experience in the area, not only in identifying the problem but helping to transfer employees to more compliant employment models.

I learnt a huge amount interviewing Christopher Hitchins on the Global Workforce Podcast recently. We talked about everything from global expansion to visa sponsorship, permanent establishment risk, employee misclassification and everything in between.

One highlight for me was about managing employee migrations, be they triggered by an M&A transaction or some other business shift. Here are my key takeaways:

  1. Consultation and communication - there may be legal requirements to go through a consultation with employees or you may be doing this as part of your integration and retention strategy but communication early with transparency is a key part of ensuring a successful migration.

  2. Empathy - put yourself in the shoes of the employees and what they’re likely to be thinking through the process. How will their work environment change? How will this impact their benefits? Will they have new reporting lines? These migrations can be an opportunity to build trust and win hearts and minds.

  3. Expertise - make sure you’re working with partners who know what they’re talking about and have been around the block a few times. Getting this process wrong can be a lot more costly than you might think.
