O-1A and National Interest Waivers Surge Under Biden Administration

Data shows a surge in high-skilled work visa applications following Biden administration reforms. O-1A visa applications (for foreign workers with extraordinary ability) rose 29% from FY 2021 to FY 2022, with approval rates climbing from 91% to 94%. National interest waiver requests saw an even more significant jump, increasing 51% in the same period with approval rates rising from 86% to 90%.   However, FY 2023 data pointed to a shifting landscape. While O-1A applications continued to rise, national interest waiver requests soared by 81%. With this influx, approval rates for these waivers dropped from 90% to 80%.

In a historic move by the Biden administration, there will soon be a pathway allowing roughly 500,000 noncitizen spouses and children who entered undocumented, at least 10 years ago, to apply for Parole in Place and thereafter permanent resident status. These spouses will also be eligible for work authorization.

This move is about hope and stability for families, a testament to the vital role immigrants play. This helps ensure that families who have built a life in the U.S. over more than ten years can continue to be positive contributors while being unburdened from the immense stress and fear that they have to live under every day.

To understand the first part of this process, applying for "parole in place" please read more in the article below. This parole process will allow certain undocumented individuals to remain in the U.S. temporarily without fear of deportation while they apply for legal status. This process aims to protect around half a million spouses and around 50,000 children.
