Judge Scarsi of the US District Court in CA issued a scathing injunction against UCLA yesterday, regarding discrimination against Jews on campus last school year.
I recommend reading the decision (https://lnkd.in/gNDHdSv5). The first paragraph is a powerful articulation of the plight of Jews on US campuses:
“In the year 2024, in the United States of America, in the State of California, in the City of Los Angeles, Jewish students were excluded from portions of the UCLA campus because they refused to denounce their faith. This fact is so unimaginable and so abhorrent to our constitutional guarantee of religious freedom that it bears repeating, Jewish students were excluded from portions of the UCLA campus because they refused to denounce their faith. UCLA does not dispute this. Instead, UCLA claims that it has no responsibility to protect the religious freedom of its Jewish students because the exclusion was engineered by third-party protesters. But under constitutional principles, UCLA may not allow services to some students when UCLA knows that other students are excluded on religious grounds, regardless of who engineered the exclusion.”
Judge Scarsi’s indignation is palpable. He went on to issue judgment on the pleadings without need for oral arguments.
But the deeper outrage in my eyes is not only that the case had to be filed but that The Regents of the University of California felt a need to challenge it! That is insane. UCLA is a state institution and it’s arguing that since 3rd parties are blocking access to public education based on religion, it is not the school’s problem.
Are they kidding? Have we not seen this movie before in the 1960’s? I recall Normal Rockwell’s iconic painting (below) of a courageous Ruby Bridges being escorted to school in New Orleans by US Marshalls, past KKK demonstrators opposing desegregation.
This terrible chapter in US history was powerfully memorialized by Rockwell. But apparently this chapter is being rewritten. Once again, violent protesters are excluding students from school based on identity, and state agencies and schools aren’t enforcing the law, so the federal government must interject. Only today, the student are Jews, the violent protesters are pro-Hamas students rather than KKK, and UCLA (and other lauded institutions like Columbia University, Massachusetts Institute of Technology, and University of Pennsylvania) are playing the part of the segregation era schools.
How can these federally and state funded institutions of enlightenment not only allow this bigotry on campus, but defend their inaction and litigate against the victims? Shame on them. Indeed, the existence of this litigation is as disturbing as the underlying facts.
313 days have past since Hamas and Iran launched their war on Israel. 115 hostages remain in Hamas’s hands. Bring them home now!
