So, when the SEC get confused about the nature of paper checks, I can rest in knowing this matter rightly belongs to the the Fed and the OCC. Essentially, the SEC is creating political risk for themselves, by trying to lay claim to the domain of other agencies.
The beauty of the law is that it's written down. So, my best move is to remind the SEC of the Law from the Fed;

This law essentially clarifies that a paper check is not "money" until it clears. Therefore, a drop-box that physically receives a paper check does NOT legally have control of funds, because that check has not cleared yet.
It's not money until it's money!
They probably don't want to die on this hill, especially when you consider this situation is to add a MANDATORY transaction ID to the paper check, in order to satisfy Treasury Anti-Money Laundering laws (AML/KYC).
