The US #FISA has been terrible law since the day that it was enacted, and has only gotten worse with time. The US intelligence community has repeatedly lied to Congress and the American people about what data they gather on Americans.
The heads of the NSA and other intelligence agencies have no compunction about using the dominant position US companies have on the Internet and the web to treat anything and everything that anyone on earth does anywhere at any time as “signals intelligence.” As I’ve said here on LinkedIn before over the last 15 years, this is a terrible policy position for US lawmakers or POTUS to support, but support it again today they have.
Unsurprisingly, governments of other countries feel perfectly within their rights to act in the same way on the web that the US intelligence community does. I don’t use TikTok, and I dislike basically all of the security laws that have been adopted in the PRC over the last decade. But you reap what you sow. The US Congress and federal administration are complete and utter hypocrites about trying to ban TikTok in the US because it is a “security threat,” during the same month that they re-empower the US intelligence community to take the exact actions that they are concerned are being done against us, Americans by the PRC thru TikTok.
I came close in 2002 to joining the US intelligence community. But the increasing soft tyranny, the corrupting influence of power that comes with global hegemony, was the primary reason I stayed in tech instead of doing clandestine intelligence. There are ways to do spying ethically, but we’ve been spying unethically for a long time on far, far too many people.
