Let's talk W-2 hiring. Small businesses are on fire with the new hires right now.

If you hire a US W-2 employee, you need:

  • An offer letter detailing these things about the role: title, full-time, part-time, seasonal, or temporary / intern; eligibility for overtime pay, wage rate, work location ("remote" is a location), and person they're reporting to

  • Employee's confirmed acceptance of these terms

  • A business and tax registration in the state (often a foreign LLC) and potentially city / county they live in

  • Registration with the state department of labor

  • Hiring notification to the state they live in

  • Workers compensation insurance

  • Verification of I-9 by the third day of employment

  • Potentially, a background check

  • Compliance with federal and local wage and hour statutes (including posters, which you may deliver electronically, frequency of pay for job type, and a wage and hour letter)

  • W-4 and payroll tax withholding

There may be more, like a statement of employee policies, paid leave compliance, regulatory registrations, an employee handbook, and NDA or confidentiality agreement...this is where it's worth it to have a local employment lawyer or general counsel on your team.

If you have been working with contractors or staffing agencies, you may be used to tossing a contract and SOW out for electronic signature and having people start within a day or two. Being a W-2 employer has quite a few more steps, which can take days or weeks.

If you've made a W-2 hire, what's something that surprised you about the process? What tips do you have for first-time small business employers?

I had a call recently with someone who had just learned they were pregnant. The call was about planning for self-employed leave and covering those expenses. Know what we ended up talking about?

Daycare.

Mostly, why you need to get on waitlists asap and how much it costs. And why universal TK in California is such a huge financial benefit. It’s one thing to set aside savings for leave, it’s quite another to have reliable time to work once you return.

What’s some unexpected advice that you’d share with a self-employed new parent?
