- Critically, the order suspends guarantees for those seeking safe haven upon stepping onto U.S. soil enshrined in U.S. and international law.
📉Resource Challenges: The border faces a lack of resources to adjudicate credible fear claims, which require an asylum officer. With limited asylum officers, DHS can either detain migrants for extended periods (weeks to months) or issue a notice to appear in court, bypassing the credible fear process and relying on a future hearing.
🛑 Biden's New Policy: To quickly remove those crossings between legal entry points if daily crossings exceed 2,500 for seven days, the administration will shut down crossings. This threshold has been frequently met, in 2024 averaging 6,000/day, which could cause a humanitarian crisis for the new President of Mexico, and increase the number of asylum seekers waiting.

- A border closure doesn’t address the resource shortage.

⚖️ Legal Framework:
- The administration uses Section 212(f) of the Immigration and Nationality Act to block certain immigrants, the same rationale used by Trump for the Muslim ban.
- Limited exceptions exist, including for unaccompanied minors and human trafficking victims. To uphold our legal and moral obligations, we need to expand resources and streamline processes to ensure a humane and efficient asylum system, which can only come from Congress.
