It’s gratifying to see the Ninth Circuit agree with an amicus brief I wrote. This opinion is an important reminder that under California (and federal) antitrust law, the jury gets to consider the alleged anticompetitive purpose of restraints of trade in determining whether anticompetitive effects were in fact felt in the marketplace.
