The USPTO issued new subject matter eligibility examples 47-49 related to AI that were effective as of July 17, 2024 including Example 47 related to Anomaly Detection, Example 48 related to Speech Separation, and Example 49 related to Fibrosis Treatment.

I am struggling to see some of the differences between older Example 39 related to training a neural network for facial detection and Claim 2 in Example 47. The claim in Example 39 is patentable subject matter and Claim 2 in Example 47 is supposedly not patentable subject matter, but why...?

I suppose there is less detail related to the training in Claim 2 in Example 47? I'm not so sure these two Examples make sense viewed side by side. The USPTO claims that the training in claim 2 in Example 47 could be done mentally...but I think that is nonsensical. The USPTO provides almost no detail for its reasoning for the claim Example 39 and says that "the claim does not recite a mental process because the steps are not practically performed in the human mind." What do you think?
