Class actions can be an effective tool for helping individuals who were misled by carriers into long-term commitments with certain Indexed Univeral Life (IUL) and Fixed Index Annuity (FIA) products. Many indexed insurance products are often illustrated in ways that do not accurately represent how the products and indexes actually function. Additionally, these illustrations and policies may not fully disclose all the fees embedded in the indexes, particularly with proprietary ones.
For those who lack the financial resources to pay for an attorney upfront or have insufficient losses to justify a lawyer taking on their individual case on a contingency basis, a class action may be the only practical option. This allows clients with modest means or losses to still access the courts.
If you have clients who are dissatisfied and feel trapped with a specific IUL or FIA policy, I’m happy to review their situation and determine if a class action might be appropriate.
