Hot off the presses, SEC opposition to Coinbase motion for judgment on the pleadings.

Note the SEC's statement on page 8: "'Investment contract' captures something other than notions of equity ownership and encompasses the variable transactions that, like any security, result in an investor parting with capital on the expectation of profit."

No, no, no!!! Not every investment with an expectation of profit is a security. Of course SEC has no cite for that statement because it is very clearly NOT the law. That over-expansive view of "security" is exactly where the SEC goes wrong.

It was an honor to submit an amicus brief on behalf of Senator Lummis in SEC v Coinbase, with my partner Michelle Kallen.

Regulation of crypto assets is an important and multi-faceted issue that should be decided by Congress. Thank you to Senator Lummis and Chris Land for their leadership on these important issues.

Many other great briefs were filed as well, and it is great to see so many members of our community coming together to move the industry forward.
