I woke up with the news of Pavel Durov's arrest in Paris because of his refuse to censor content on Telegram Messenger, sparking crucial discussions about platform liability and censorship.
This recent arrest has started intense debate around two critical issues:
- Should the owner of a platform (whether Telegram Messenger, Meta Facebook, X, YouTube, a newspaper, or a television program) be held responsible for how third parties use it?
- Who has the authority to dictate what content is illegal? While we universally condemn illegal activities like pedophilia, the lines blur when it comes to political views. It’s worth noting that Pavel Durov had to flee Russia because he refused to censor Telegram against the Russian opposition.
This arrest however highlights another critical issue: governments have not fully grasp the implications of decentralized social media platforms that already exist.
Thanks to protocols like #nostr, endorsed by Twitter founder Jack Dorsey, we now have social platforms that are resistant to censorship. The #nostr protocol is a decentralized communication system for social media that lets users control their own identities and data using cryptographic keys. Users publish posts to multiple relays instead of a central server. This makes it virtually impossible for states to shut down all access points worldwide, rendering censorship ineffective on a #nostr-based platform.
Currently, only a niche group of crypto enthusiasts are using this, but as traditional social media faces increasing censorship, we will likely see a rise in the use of such protocols. Initially, this shift might attract criminals and illegal content, but it will for sure also extend to people living under repressive regimes or those in marginalized communities who face censorship by their governments and, finally, to people who care about their privacy.
The key takeaway is that in the near future, it may become impossible for states to censor social media effectively. This calls for a shift in mentality. Instead of the state dictating what is right or wrong, society should take on that role. Simply banning illegal content won't eliminate criminal behavior. We must educate our society, address the root causes of criminal activity, and tackle those issues head-on.
I believe that the Telegram/Durov case could be the catalyst for this change, so we should prepare for what’s to come.
What a week! The crypto scene has never been so active! Last Friday I presented the LVGA token case of the City of Lugano in Monaco at Top Marques Monaco invited by zondacrypto together with Przemyslaw Kral, Guido Buehler, Dr. Mattia L. Rattaggi and Piotr Obidziński and on Tuesday I presented the same topic at Banque SYZ & CO in Geneva together with Charles-Henry Monchau, CFA, CMT, CAIA and Valérie Noël. The day after I travelled to Zürich for a lunch organized by Kerem Kolcuoglu in relation to the ETP Digital Asset summit. Finally today and tomorrow I will discuss regulatory topics at NFT Fest in Lugano with all my fellow colleagues Stéphanie Fuchs 富彩蝶, Janina Vinklere, Franziska Gall, Andreas Glarner, Marco Tullio Giordano, Federico Bonardi.
