President of the Republic [2022] SCJ 37: the Supreme Court acceded to the President's motion to be put out of cause in Betamax's judicial review case challenging his decision to set up a Commission of Inquiry on the contract between Betamax and the State Trading Corporation.
The decision does not rock the boat. However it raises important questions on the accountability of the President before our courts: are all his decisions reviewable by the Court? If not, which ones are not reviewable? How can our existing constitutional be "fine-tuned"?
