No cash in the register! Why was summary judgment refused in software IP ownership dispute?

An application for summary judgment was recently refused on the basis that the ownership of IP rights relating to software integrated into point-of-sale cash registers was too complicated for a summary judgment determination.

The dispute arose after a company was purchased and the licensing structure was questioned. There was no signed assignment with the software developers meaning that the purchasers had to rely on beneficial ownership.

A helpful reminder of the importance of getting written contracts in place when IP works are commissioned.

When are a 'crowded market' and earlier coexistence agreements relevant to trade mark infringement?

In July 2023, Mellor J found that there was no infringement or passing off in an English case concerning the heavily litigated Beverly Hills Polo Club trade marks.

One of the key points on appeal was whether the first instance judge had been overly focused on: (i) the fact that a lot of other clothing companies used similar signs (i.e. there was a 'crowded market') and (ii) the significance of earlier coexistence agreements which were included in evidence as a means of giving some insight into what market participants consider to be acceptable or unacceptable.
