7 insights from 'The State of AI Regulation Across the Globe" discussion run by the Berkman Klein Centre for Internet and Society at Harvard.
-
The EU's Risk-Based AI act (being the first legislated for) serves as a reference model from which other regions and countries will deviate and/or replicate.
-
The US is likely to take some time before a national text emerges, and unwritten stance is that business should remember that AI is subject to governance under existing laws (IP/Competition etc.).
-
In the US, AI regulation is likely to proliferate state by state on specific issues e.g. New York regulating models related to hiring and promotion
-
In LATAM there are concerns that AI regulations in Cost Rica and Brazil which include strict liability obligations are too severe and in-effect re-writing regular law.
-
On the African continent the African Union has developed a draft framework to provide guidance to its 55 member states but there is some hesitation to regulate and block innovation when opportunities are already constrained (limited data infrastructure, a lack of funding, computing power, and the ownership of African data).
-
There are concerns on how AI regulation will be enforced, particularly where there are already constrained public finances. The EU are establishing a 140 person AI Office for enforcement.
-
Moral rights will prevail when considering the risks of AI in the Arts and Culture. I tend to agree, who really wants AI generated Art? It feels inauthentic....same as AI generated Netflix storylines.
I plan on sharing much more research and POV content like this on what I am doing, reading and observing so feel free to engage, comment or leave a question below
