Highlights
Details matter. In the attached FLSD decision, a prevailing plaintiff was denied fees under the Florida Deceptive and Unfair Trade Practice Act. Why? According to the Court, Plaintiff's counsel failed to adequately explain why the Court should exercise its discretion and award fees, presuming that fee-shifting was a given (spoiler alert: FDUTPA has a discretionary fee shifting, not mandatory). As noted by Judge Goodman: “it is not the Court's job to do Plaintiff's work for it.” Hat tip to Larry Silverman for sharing this case in his FDUTPA digest.
