Today, San Francisco Superior Court Judge Ethan Schulman ruled in favor of clients represented by Swanson & McNamara in a lawsuit brought by the City of San Francisco that attempted to permanently banish people from the Tenderloin. Last year, the City sued 28 individuals under California’s public nuisance and Unfair Competition Law. Based only on a small number of arrests for street-level drug sales, the City sought to ban the defendants from a 50-block area in the Tenderloin indefinitely and for any purpose. Swanson & McNamara LLP, along with the ACLU and DLA Piper, has been providing pro bono representation to the defendants who are opposing the lawsuits.

Judge Schulman denied the City’s request for a preliminary injunction in a resounding victory for our clients and for constitutional liberties. The Court made clear that the City’s goal in bringing these cases—barring our clients from an entire neighborhood—is unlawful and unconstitutional: “In short, in California even a criminal court does not have the power to banish a defendant. . . If a court cannot enter such an exclusion order as a condition of probation following a criminal conviction, it certainly cannot do so in the guise of a civil injunction.”
