Earlier this month, a federal judge in Alabama declared the CTA unconstitutional. The U.S. Government has already filed a notice of appeal and this issue could very well go all the way to the Supreme Court.
The Alabama judge's decision only applies to the plaintiffs in the lawsuit, the National Small Business Association, its members, and the individual plaintiff, meaning that FinCEN cannot enforce the CTA against them for now. However, FinCEN has made clear that it "will continue to implement the Corporate Transparency Act" and "reporting companies are still required to comply with the law and file beneficial ownership reports as provided in FinCEN's regulations."
