On Thursday, 6/29, federal banking regulatory agencies released a joint statement asking banks and credit unions to amicably work with defaulting commercial real estate borrowers in avoiding foreclosures where possible (see: SR 23-5 attachment: Policy Statement on Prudent Commercial Real Estate Loan Accommodations and Workouts (federalreserve.gov); Policy Statement on Prudent Commercial Real Estate Loan Accommodations and Workouts (federalreserve.gov); FDIC: PR-51-2023 6/29/2023).

In their joint statement, recommendations were made for deferrals, along with other short-term modifications prior to engaging in formal workout agreements. Similar types of workout arrangements were also prevalent during the 2008/2009 financial crisis.

This may be a sign that there will be substantial commercial real estate defaults on the horizon, which may result in lease restructuring negotiations between commercial tenants and landlords, as well as loan workouts between banks and landlords. Of course, if there are myriad defaults and short-term modifications cannot be reached, it will invariably lead to a proliferation of litigation.
