Highlights
Mickey Mouse has long had an iconic status in copyright law. As the US repeatedly pushed out the term of copyright protection, it was generally regarded that a major motivation was to afford continued protection to iconic works such as early Walt Disney cartoons.
Now, the 1928 cartoon "Steamboat Willie" is due to come out of copyright in the USA: https://lnkd.in/gqnaTVmJ. It will be interesting to see what happens, and how third parties may seek to utilise that work.
It won't be a free-for-all on Mickey Mouse and other Disney creations. Later cartoons will still be subject to copyright, and Disney has a whole slew of trade mark registrations covering Mickey Mouse and his iconic ears. But I'm sure that some people will try things, and Disney may well seek to stop them based on its remaining IP (such as by alleging trade mark infringement).
A lesson for us today: if a copyright work has effectively become your business' brand, then you should register it as a trade mark. Trade marks can live forever (provided that they are renewed and remain valid), while copyright has a finite life. #macphersonkelley #mickeymouse #disney #waltdisney #steamboatwillie #copyright #copyrightlaw #iplaw
