In the words of #privacyflorence+themachine: "The pattern is always darkest before the dawn" - California Privacy Protection Agency issues enforcement advisory on dark patterns. What do you need to know?

🔹Don't say you didn't mean to: “Dark patterns aren’t about intent, they’re about effect,” said Michael Macko, Deputy Director of the CPPA’s Enforcement Division. "The law gives consumers the right to make their privacy choices without jumping through confusing hoops or solving puzzles. Businesses need to ask themselves the right questions about their user interfaces and make sure they aren’t part of the problem.”

🔹 What is a dark pattern? user interfaces that subvert or impair consumers’ autonomy, decisionmaking, or choice when asserting their privacy rights or consenting 🔹If the choices are unclear, they might be considered dark patterns 🔹Agreement obtained through use of dark patterns does not constitute consent

What to do now? 🔹Review your user interfaces to ensure you offer symmetrical choices and use clear, easy-to-understand language offering privacy choices 🔹Review interfaces provided by your service providers such as consent management platforms 🔹Use language that is easy for consumers to read and understand 🔹Use plain, straightforward language and avoid technical or legal jargon 🔹Symmetry: The path for a consumer to exercise a more privacy-protective option shall not be longer or more difficult or time-consuming than the path to exercise a less privacy-protective option

"The question is not whether the perfect hero exists but whether we choose to focus on the core characteristics of the person, on his achievements and contributions or actively seek (and inevitably find) a fault.

To do harm by not doing makes one a coward, not a saint. The true heroes are those who permit themselves to be human - who understand that to do good is to risk failure, that to act is to risk getting dirty. And we, who sit around the dinner table, should say grace and thank those brave, imperfect mortals."
